Point is it plagiarism or fair use I suggest only a court is competent to decide such. Critics usually have other motives for spinning such stories besides fair play
An example I would single out to illustrate this issue is the Artist Jeff Koons who is no stranger to copyright infringement because unless it is that than the debate is nothing but guff
He lost in Rogers v. Koons, for his use of a photograph of puppies as the basis for a sculpture, String of Puppies, and won in Blanch v. Koons, over his use of a photographic advertisement as source material for legs and feet in a painting, Niagara.
He himself claimed copyright infringement claiming that a bookstore in San Francisco was selling bookends based on his balloon dog sculpture, the claim was abandoned when the defendant filed for declaratory relief stating, As any clown can attest, no one owns the idea of making a balloon dog,
